You agree to provide accurate information when submitting the contact form or OCI diagnostic, not to attempt to circumvent, overload, or interfere with the operation of the Site or its bot-detection systems, and not to use the Site for any unlawful purpose or to submit content that is abusive, fraudulent, or infringes another party's rights. We may suspend or terminate your access to the Site, in whole or in part, if we reasonably believe you have misused it.

All content on the Site — including text, the Operational Confidence Index framework and questions, scoring methodology, and any report generated for you — is owned by, or licensed to, Rullan Scott Technologies and is protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to view the Site and to use your own OCI report for your internal business purposes. You may not reproduce, redistribute, or create derivative works from the OCI framework or the Site's content without our prior written consent.

The Operational Confidence Index (OCI) is a self-assessment questionnaire that you complete. It returns an indicative score, a breakdown by domain, and a report generated from the answers you provide. It is not an audit, and does not involve Rullan Scott connecting to, inspecting, or otherwise accessing your systems. The accuracy and usefulness of your score and report depend entirely on the accuracy of the answers you supply.

The content of the Site, and the OCI diagnostic and any report it generates, are provided for general informational purposes only and do not constitute professional, technical, security, legal, or financial advice. They are not a substitute for a proper technical audit or a contracted advisory engagement. You should not rely on the Site's content or your OCI report as the sole basis for any decision about your technology environment; where advice you can rely on is needed, engage us — or another qualified advisor — directly, on agreed terms.

THE SITE AND THE OCI DIAGNOSTIC ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE FULLEST EXTENT PERMITTED BY LAW, RULLAN SCOTT TECHNOLOGIES AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SITE OR RELIANCE ON YOUR OCI REPORT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to indemnify and hold harmless Rullan Scott Technologies and its members, managers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or your violation of these Terms.

The Site may link to third-party websites or resources. We are not responsible for the content, accuracy, or availability of any third-party site, and including a link does not imply our endorsement of it.

Personal information submitted through the Site is handled in accordance with our Privacy Policy.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Orange County, Florida, and you consent to the personal jurisdiction of those courts.

We may revise these Terms at any time. Changes take effect as soon as they are posted on this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
